It is a mechanism, promoted by the government of Spain, that allows companies and individuals to obtain economic benefits through the sale of certified energy savings.

An Energy Saving Certificate (ESC) is an electronic document that guarantees that, after carrying out an energy efficiency action, a new final energy saving has been achieved.

1 ESC = 1 kWh

According to the Ministry for the Ecological Transition and the Demographic Challenge, any action that saves energy can generate ESC. These actions are divided into two types:

Energy Saving Certificates (ESC) certify and monetise energy savings achieved through energy efficiency improvements. These certificates can be sold or exchanged on the market by delegated and reporting parties, enabling the companies or individuals that generate them to obtain economic benefits.

In order to calculate the energy savings of your activity, the activity itself must first be analysed, in other words, it must initially be determined whether it’s singular or standardised and the corresponding calculations must be made upon this basis. The calculations can vary significantly from one activity to another, as the energy saved by replacing heat pumps, for example, isn’t the same as that saved by insulating façades. The final calculation must deliver a value expressed in KWh/year, which is the unit of measurement of energy saved in a whole year due to the energy improvement.

Generally speaking, the following requirements must be met for an activity to qualify for the generation of ESC

  • It mustn’t have been launched before 26 January 2023
  • It must be executed in Spain
  • It must have generated savings with respect to the initial situation (new installations are generally not included, they are always replacements)
  • The activity mustn’t have undergone any change of use during its execution

However, even if they meet all these requirements, the activities must be individually examined to assess whether there are any particular constraints that may limit their options of obtaining an ESC.

The price of the energy savings to be charged by the initial owner will vary, depending on several factors:

  • Market supply and demand
  • The sector of the activity
  • The type of activity (singular or standardised)

The prices are determined by kWh/year or MWh/year (=1,000 kWh/year). Moreover, the prices are not fixed, given that, as mentioned above, they will increase or decrease, depending on the supply and demand.

An ESC has a single value of 1kWh of final energy consumption savings (Royal Decree 36/2023 of 24 January, article 8.2).
A CAE has a unique value of 1kWh of final energy consumption savings (Royal Decree 36/2023, of January 24, article 8.2).
Yes, but only by reporting parties (RPs) and delegated parties (DPs) (Royal Decree 36/2023 of 24 January, article 8.1; Order TED/815/2023 of 18 July, article 17.2).
Only a reporting party (RP) or delegated party (DP) to which an ESC has been issued or which has acquired it through a legal purchase and sale transaction (Royal Decree 36/2023 of 24 January, article 2.i and article 8.1).

Yes, if you intend to carry out an energy efficiency activity liable to generate final energy savings.

In this case, you may be regarded as an Energy Savings Owner, in accordance with the provisions of article 12.1 of Royal Decree 36/2023 of 24 January establishing an Energy Saving Certificate system.

The above energy savings may be transferred to a third party by means of the signing of a private covenant or agreement or directly to an RP or DP by means of the signing of an ESC Agreement (Royal Decree 36/2023 of 24 January, article 12.1; Order TED/815/2023 of 18 July, article 11).

The owner of the energy savings is the natural or legal person of a public or private nature which makes the investment in the energy efficiency activity with the aim of obtaining energy savings for itself or a third party, or the natural or legal person to which the savings generated by said activity have been assigned (Royal Decree 36/2023 of 24 January, article 2.f).

In this case, you may be regarded as an Owner of Energy Savings, in accordance with the provisions of article 12.1 of Royal Decree 36/2023 of 24 January, establishing an Energy Saving Certificate system.

The above energy savings may be transferred to a third party by means of the signing of a private covenant or agreement or directly to an RP or DP by means of the signing of an ESC Agreement (Royal Decree 36/2023 of 24 January, article 12.1; Order TED/815/2023 of 18 July, article 11).

Only entities regarded as reporting parties or entities which have been accredited as delegated parties can apply for verification of their energy savings by the savings verifier. Neither the owner of the savings nor any other agent of the system without the status of a reporting or delegated party may request verification of the savings of an executed activity (Royal Decree 36/2023 of 24 January, article 12.2; Order TED/815/2023 of 18 July, article 13).
The minimum size of the file to apply for the issuance of an ESC is 30 MWh, which can be covered by the sum total of the savings from the different (standardised and/or singular) activities included in the application (Order TED/815/2023 of 18 July, article 14.6).

The body or entity responsible for energy efficiency in the Autonomous Community in which the activity generating the energy savings has been carried out (regional manager).

To do so, the reporting or delegated party must submit an application for the issuance of an ESC to the regional manager, together with a file that includes the verifier’s Favourable Opinion and report (Royal Decree 36/2023 of 24 January, article 13).

All energy supplied to industry, transport, households, services and agriculture. It doesn’t include supplies to the energy transformation sector and the energy industries themselves (Royal Decree 36/2023 of 24 January, article 2).

The ESC agreement is an agreement signed by the reporting or delegated party and the owner of the energy savings, whereby the latter assigns the energy savings to the former in exchange for a consideration, thus guaranteeing the incentive effect.

Article 11.2 of Order TED/815/2023 of 18 July establishes the minimum content of this agreement.

Any activity that is linked or related to a new equipment installation or construction will not be eligible for the ESC System, in application of the new Directive (EU) 2023/1791 of the European Parliament and of the Council of 13 September on energy efficiency and amending Regulation (EU) 2023/955.
Generally speaking, the financing of energy efficiency activities whose savings are converted into ESC will be compatible with public aid and subsidy programmes, except for those financed by the FNEE (Order TED/815/2023 of 18 July, article 14.8).
